JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-06-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sheosagar P.S. Case no. 284/14 registered under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act. The accusation is that on secret information the Police raided the hotel of the petitioner and seized 103 pouches each 200 ml., illegal country-made wine and other article. The petitioner fled away from the hotel.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case at the instance of his enemies and the petitioner was never seen selling the aforesaid

Patna High Court Cr.Misc. No.17154 of 2015 (2) dt.03-06-2015 P2/2 spurious liquor which was not fit for human consumption, in his hotel and he was not known to the fact that the liquor is being sold in hotel.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected.

The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
