The petitioner in the present case is seeking anticipatory bail in connection with Dulhin Bazar P.S. Case No. 02 of 2019 registered for the offences punishable under Sections 341, 323, 307, 504 of the Indian Penal Code. Learned counsel for the petitioner submits that the injury attributed to the petitioner does not make out a case of 307 IPC as the same has been found to be simple in nature. Learned APP for the State opposed the prayer of anticipatory bail.
Considering the facts and circumstances wherein it appears that the doctor has found one injury of swelling on the backside of the head which is said to be simple in nature and the same was attributed to this petitioner, let the petitioner above
Patna High Court CR. MISC. No.35206 of 2019(6) dt.27-09-2019 2/2 named in the event of his arrest or surrender within a period of four weeks from today in connection with Dulhin Bazar P.S. Case No. 02 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, Danapur, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
