JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Pusa P.S. Case No. 101 of 2016 registered under Sections 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation, the name of the petitioner has been surfaced in the confessional statement of co-accused, Shivam Kumar and Abhishek Kumar having hand in the loot of laptop and cash of Rs.3,50,000/- and thereafter petitioner was apprehended from his house on 15.10.2016, showing the recovery of looted cash of Rs.5,000/- It is further submitted that petitioner has no criminal antecedent and he is in custody since 15.10.2016.

Patna High Court Cr.Misc. No.1117 of 2017 (2) dt.13-01-2017 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Pusa P.S. Case No. 101 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
