The petitioner has preferred this application for grant of regular bail in a case registered under section 399 and 402 of the Indian Penal Code and sections 25(1-B)(a) and 26 of the Arms Act.

As per the prosecution case, a country-made pistol and a live cartridge was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 22.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent and having remained in custody for more than 10 months, the petitioner is directed to be enlarged on bail in connection with Baruraj P.S. Case no. 45 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur.
