2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 324(4), 303(2), 117(2), 109 and 103(2) of the B.N.S.

3. The case of the prosecution in short is that the petitioners along with other 7-8 persons in number have assaulted badly one Rahul Kumar. Rahul Kumar was referred to Patna for better treatment and in course of treatment he died.

4. Learned counsel for the petitioners has submitted that there is also a counter version of this case. It has also been submitted that nature of allegation is general and omnibus.

Patna High Court CR. MISC. No.38378 of 2025(3) dt.02-09-2025 2/2 There is no specific allegation against these petitioners. It is alleged that all the accused persons named in the FIR assaulted badly. Petitioners are in custody since 01.02.2025 and 21.01.2025 respectively.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioners.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Kako P.S. Case No. 304 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each of them with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad.
