The petitioners seek pre-arrest bail in connection with Konch P.S. Case No.64 of 2020 registered for the offences punishable under Sections 341, 343 and 307 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that though there is allegation that five persons assaulted the informant with lathi, danda, the doctor, who examined her could find only one injury on her person. It is further contended that two lady co-accused have already been granted pre-arrest bail by the court below. It is also contended

Patna High Court CR. MISC. No.36182 of 2020(2) dt.25-05-2021 2/3 that there is no truth behind the allegation made in the first information report and a minor scuffle between the parties over the petty issue has been given a colour of grievous offence. 4.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioners. 5.

Considering the nature of the allegation made in the FIR and the submissions advanced at the Bar, the petitioners are directed to be released on bail in the event of their arrest or surrender on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-3rd, Gaya in connection with Konch P.S. Case No.64 of 2020 subject to the condition as laid down under Section 438 of the Code of Criminal Procedure.

Since the court proceedings are being conducted through virtual mode and normal court functioning has not been restored till date, it is considered appropriate to adopt the following procedure for communication of the present order:- (i) The order, which has been dictated during the course of proceeding of the virtual court, shall be communicated to me electronically by the Joint Registrar-cum-Addl. PPS.

Patna High Court CR. MISC. No.36182 of 2020(2) dt.25-05-2021 3/3 (ii) The corrected copy of the order shall be transmitted by me to the Joint Registrar-cum-Addl. PPS electronically, which shall be treated to be an authentic copy of the order passed by this Court in the present proceeding.

(iii) Hard copy of the order duly signed by me shall be preserved in my residential office for documentation and future use, if any.

(iv) Let steps be taken by the Joint Registrar-cum-Addl. PPS/registry for up-loading of the present order without compromising with the norms of social distancing.
