JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2017 The petitioner is in custody since 12.12.2016 in connection with Karpi (Sahar Telpa) P.S. Case No. 176 of 2015 registered for offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that allegation against the petitioner that he has obtained loan by mortgaging forged document for purchase of tractor, but there are material on the record, which shows that no tractor has ever been purchased and the allegations are completely baseless. It has further been submitted that the petitioner has already filed a complaint case against the informant side for the same. Heard learned A.P.P. and learned counsel for the informant also.

Having heard both sides, considering the fact that there is nothing on record so as to suggest the petitioenr's involvement in the alleged fraud and he has been in judicial custody for about two

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Karpi (Sahar Telpa) P.S. Case No. 176 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
