Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 201 and 34 of the IPC.

As per the prosecution case, the informant suspects that FIR named accused persons including the petitioner committed murder of the deceased.

Learned counsel appearing for the petitioner submits that it is co accused Rupesh Kumar and Kanahi Kumar who are alleged to have threatened the deceased prior to the occurrence. There is only reference of this petitioner in the First Information Report but no role of overt act has been attributed to

Patna High Court CR. MISC. No.39371 of 2022(2) dt.23-11-2022 2/2 petitioner. During investigation no tangible evidence has been collected to connect the petitioner with the occurrence. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-12 cum Sub- Judge- IV, Muzaffarpur in connection with Sakra P.S. Case No. 266 of 2020 dated 26.06.2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
