2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Paraiya P.S. Case No. 208 of 2019 dated 26.11.2019 lodged under Sections 304(B) and 201/34 of the I.P.C.

4. As per the prosecution, the informant has filed this case against the petitioner and others for dowry death of her daughter.

5. Learned counsel for the petitioner submits that petitioner is in custody since 26.03.2023 and there is one criminal antecedent against the petitioner in which he is on bail. He further submits that charge sheet has already been filed in this case but counsel further submits that the allegation made in the FIR is absolutely false and the informant herself realize later

Patna High Court CR. MISC. No.39131 of 2023(2) dt.07-07-2023 2/2 on that her daughter died due to illness and under confusion, she has filed this criminal case against the petitioner and others. He further submits that upon realizing, she filed an affidavit in this regard before the trial court. Counsel further submits that other co-accused persons have been granted bail by the Co-ordinate Bench of this Court vide order dated 17.01.2022 passed in Cr. Misc. Case No. 15453 of 2021.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Gaya in connection with Paraiya P.S. Case No. 208 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C..

8. With this observation, the bail application stands allowed.
