ANJANA MISHRA ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner, learned counsel for the informant, learned counsel for the Bank and learned A.P.P. for the State.

Petitioner is apprehending his arrest in connection with Kateya P. S. Case no. 284 of 2014 registered under Sections 420, 467 and 471 of the Indian Penal Code.

A counter affidavit has been filed by the bank which goes to show that in terms of the policy of the bank, it had encashed the F.D.R. in favour of the petitioner. Learned counsel for the bank has pointed out Annexures- B and C, which are documents and go to show that transaction and encashment of the F.D.R. was made in a bonafide manner.

Considering the stand taken by the bank and keeping in view the application of the petitioner that he is seeking to get the benefit of ad interim anticipatory bail, let petitioner above named,

No.16740 of 2015 (4) dt.14-09-2015 2 / 2 in the event of arrest or surrender within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri R. K. Pandey, Judicial Magistrate, Ist Class, Gopalganj, in connection with Kateya P. S. Case no. 284 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
