The Petitioner seeks bail in Garkha P.S. Case No.327 of 2016 instituted for the offence under Section(s) 395, 397 Indian Penal Code.
It is alleged that on the point of pistol dacoity was committed in the house of the Informant and on protest the miscreants assaulted the family members and thereafter the inmates of the house caught two miscreants and when they were taken inside the house, other miscreants started firing and the miscreants managed to run away.
It has been submitted that from the order of the Court below itself it appears that the name of this petitioner has come in
Patna High Court Cr.Misc. No.1171 of 2017 (2) dt.31-01-2017 2/2 the confessional statement of co-accused, Prabhat Manjhi, as mentioned in para 6 of the Case Diary.
The petitioner is not named in the First Information Report. It has been submitted that one of the co-accused has been granted bail by a co-ordinate Bench of this Court by order dated 25.01.2017 passed in Cr. Misc. No.1878 of 2017 In the circumstances, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. V, Saran at Chapra, in connection with Garkha P.S. Case No.327 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
