JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 21-10-2022 Learned counsel for the petitioner shall remove all the S.R. defects within a period of four weeks from today. Heard learned counsel for the petitioner and Mr. Anil Kumar, learned AC to SC-8 for the State.

The only grievance of the petitioner in the present writ application is that the investigation of Shri Krishnapuri P.S. Case No. 338 of 2021 registered for the offences under Sections 34, 120B, 419, 420, 423, 447, 448, 465, 466, 467, 468 & 471 of

Patna High Court CR. WJC No.809 of 2022(2) dt.21-10-2022 2/3 the I.P.C. have not been completed so far. It is further pointed out that the petitioner has filed representation before the respondents seeking completion of investigation of the case but it has not been taken care of. It is further stated that apart from the present case, there are several other cases registered against the accused persons of the instant case such as Shri Krishnapuri P.S. Case No. 460 of 2013 and even in the said case, there is no progress in investigation. It is submitted that in such circumstance, the petitioner has requested the respondents to transfer the investigation of the case to the co-operative Cell of Economic Offences Unit as the accused persons of the instant case stands charge-sheeted by co-operative Cell of Economic Offences Unit for similar offences in Shri Krishnapuri P.S. Case Nos. 52 of 2003 & 228 of 2008 relating to the same co-operative society.

Learned counsel for the State submits that in the given facts and circumstances of the case, appropriate directions may be given to the competent authority to look into the grievance of the petitioner and take an appropriate view of the matter. Having regard to the facts and circumstances noticed hereinabove and the materials available on the record, without going into the merit of the contentions of the petitioner at this

Patna High Court CR. WJC No.809 of 2022(2) dt.21-10-2022 3/3 stage, this Court directs the Director General of Police, Bihar (Respondent No. 2) to look into the grievance of the petitioner, examine the same and in case, the grievance of the petitioner is found to be genuine, appropriate directions in accordance with law must be issued.

Let the entire exercise be completed within a period of four months from the date of receipt/communication of a copy of this order.

This application stands disposed of accordingly. Certified copy of this order shall be made available only after removal of the defects.
