2. The petitioner apprehends his arrest in Jalalgarh P.S. Case No. 118 of 2022, registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner along with co-accused enticed away the daughter of informant and one Tamanna Khatoon and committed rape with daughter of informant.

4. It is submitted by the counsel for petitioner that petitioner has been falsely implicated in this case. Specific accusation of committing rape is against co-accused Tajir @ Aasik. Petitioner claims clean antecedent.

5. Counsel for State vehemently opposed the prayer

Patna High Court CR. MISC. No.41971 of 2023(3) dt.29-08-2023 2/2 for bail and submitted that the victim girl in her statement under Section 164 Cr.P.C has duly support the prosecution case.

6. Considering the statement of victim girl under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
