2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 137(2), 140(3) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 14.10.2024, son of informant went to visit Durga Mata temple but did not return. Thereafter, informant and his relatives began to search him but he was not found. Hence, F.I.R., was lodged against unknown.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused persons. Except

Patna High Court CR. MISC. No.39370 of 2025(3) dt.17-11-2025 2/2 confessional statement, there is no other material available on record to substantiate the allegation levelled against the petitioner. Petitioner is co-villager of the informant and has got no concern with him. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that it is a case of honour killing. During investigation, it has come that this petitioner along with other accused persons played active role and participated in the alleged occurrence. CDR attached with the record shows connections between the accused and role of the petitioner emerged in the confessional statement of co-accused.

6. Considering the nature of accusation and materials advanced during course of investigation, prayer for anticipatory bail of the petitioner is refused.
