This is a petition for grant of regular bail for offences under Sections 399, 402, 414, 467, 468, 471, 420, 307 and 34 of the Indian Penal Code and 25(1-b)a, 26, 27 and 35 of the Arms Act.
When the police had gone to raid and arrest the criminals in the house of the co-accused, Akhilesh Pandey, the criminals allegedly fired causing injury to the police personnel. Co-accused, Akhilesh Pandey, also fired, who has been granted bail by this Court in Cr. Misc. No. 27107 of 2014 on 15.01.2015 by a coordinate Bench of this Court.
However, the petitioner, having similar allegation, was refused bail earlier in Cr. Misc. No. 8189 of 2015 though the petitioner is in custody since 07.01.2014.
Considering the period already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 457 of 2014 arising out of Kochas P.S. Case No. 142 of 2013 to the satisfaction of the Additional Sessions Judge, II, Rohtas at Sasaram, or successor Court.
