====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2021 Heard learned counsel for the petitioner and the State.
The petitioner is in custody in connection with SC No. 374 of 2017 arising out of Khagaria (Muffasil) P.S. Case No. 369 of 2017 for the offences under Sections 341, 323, 307, 302/34 IPC.
Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was twice rejected by this Court. However, while rejecting the application for bail, the Court below was directed to expedite the trial but notwithstanding the direction of this Court for expeditious disposal of the trial, the trial has not been concluded as yet. The petitioner is in custody since 3.6.2017.
Considering the aforesaid facts and circumstances, the
Patna High Court CR. MISC. No.35957 of 2020(2) dt.22-01-2021 2/2 Court is constrained to direct the court below to expedite the trial and conclude the same positively within a period of four months from the date of receipt/production of a copy of this order failing which the court below shall release the petitioner on appropriate terms and conditions and submit failure report as to non-conclusion of the trial despite direction of this Court to the Registrar (Vigilance) of this Court.
