2. In the instant writ petition, the petitioners have prayed for the following relief(s):

"1. That this is an application for issuance of an appropriate writ(s), order(s) or direction(s) to the respondents to take a decision in respect of the representation dated 04.03.2021 the

Patna High Court CWJC No.10216 of 2022(3) dt.20-07-2026 2/3 respondent 2nd set have encroached the Public Land of well being its Khata No. 728, Plot No. 2896, Area 2 decimal which is situated in front of the house of the petitioners as well as which is exit the house of the petitioners and the said land of well which is connected the road except this 2 decimal of land having its Khata No. 728 plot no. 2897 which is use by road under the West Sareya Gram Panchayat of Paharpur Anchal within the territorial jurisdiction of East Champaran."

3. Learned counsel for the petitioners submits that petitioners have filed representation before the Circle Officer, Circle Paharpur, East Champaran in respect of encroachment on land, but no action has been taken till date.

4. Learned counsel for the State submits that the said issued cannot be raised in the writ petition.

5. Having heard the contention of the learned counsel for the parties, in view of the fact that representation of the petitioners is still pending before the C.O, Paharpur, East Champaran. The Circle Officer, Circle Paharpur, East Champaran is directed to look into the matter and pass a speaking order within a period of six weeks.

6. With the aforesaid observation and direction, the present Writ Petition stands disposed of.
