Aslam Ansari, learned A.P.P. as well as Sri Kumar Birendra Narain, learned counsel, who has appeared on behalf of the informant /opposite party no. 2. In the present petition vide order dated 16.5.2016 while directing for issuance of notice to the opposite party no. 2 this court had summoned report regarding the stage of the case which has been received and kept on record. The report of the concerned Magistrate dated 14.7.2016 indicates that till 16.6.2016 five witnesses had already been examined whereas in the present petition petitioner has assailed the order of rejection of

Patna High Court Cr.Misc. No.36842 of 2013 (6) dt.25-07-2016 2/2 discharge petition. Since trial is at the fag end there is no reason for passing favourable order.

The petition stands disposed of.
