The petitioner apprehends his arrest in connection with Amarpur P.S. Case no. 505 of 2018, registered under Sections 341, 323, 324 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 23.09.2019, at about 11.00 A.M. petitioner Md. Munna, Md. Monu along with two unknown persons started to cause assault to Md. Sarfaraj, son of the informant, when informant Md. Samshad rushed there then petitioner gave Axe blow at the head of the informant, as a result thereof, he fell down on the ground and when other family members of the informant rushed there then they were also assaulted by them. At that time, Md. Sahid, Md. Samsad,

Patna High Court CR. MISC. No.44796 of 2019(2) dt.22-07-2019 2/2 Md. Mahshar and Bibi Aaisa sustained injuries. Learned counsel for the petitioner submits that, in fact, occurrence of Marpit took place due to dispute arose in procession of Taziya in which petitioners' side also sustained injuries regarding which Amarpur P.S. Case No. 506 of 2018 was instituted on the basis of fardbeyan of Bibi Shayauta. Moreover, the injuries as found on the person of informant and others are simple in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 505 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
