2.Let the defect(s), if any, be removed within a period of four weeks from today.
3.The petitioner seeks bail in connection with Chapra Rail P.S. Case No. 82 of 2023 registered for the offence under Sections 395, 397 and 412 of the Indian Penal Code. 4.As per prosecution case, the accused persons looted Rs. 400/-, Mobile Phone, Aadhar Card and A.T.M. Card from the victim.
5.Learned counsel for the petitioner submits that the petitioner is in custody since 05.04.2023 and the name of the petitioner has come on the confession of the co-accused. 6.Learned counsel for the petitioner further submits
Patna High Court CR. MISC. No.41664 of 2023(2) dt.14-07-2023 2/2 that the F.I.R. is against five unknown persons and the petitioner is not named in the F.I.R.
7.Learned A.P.P. has vehemently opposed the prayer for bail.
8.Considering the aforesaid facts, this application for regular bail is allowed.
9.Let the petitioner, above named, be released on bail after completing nine months in custody and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railwayy Judicial Magistrate/concerned Court below in connection with Chapra Rail P.S.
