2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103 and 3(5) of the B.N.S..

3. As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons, including this petitioner, came on a motorcycle and forcibly tried to sit younger son of informant on the motorcycle and when he resisted, all the accused persons, having knife in their hands, assaulted him due to which son of informant received grievous injuries and subsequently, during course of treatment, son of informant died.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.39441 of 2025(3) dt.31-10-2025 2/2 that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case with ulterior motive. Allegation of stabbing is general and omnibus. Petitioner has got no criminal antecedents and he is in custody since 20.02.2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other F.I.R. named accused persons, inflicted multiple knife blows on the body of the deceased as a result of which he died during course of treatment. Case of death has been determined as hemorrhage and shock due to sharp cut injuries.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation and gravity of offence, the prayer for grant bail of to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
