ANJANA MISHRA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Complaint Case No.99-C of 2014 for allegedly having committed the offences under Section 420/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the present case is out and out a civil dispute and only on account of the fact that some amount has remained due with the complainant, she has filed the present case making fabricated allegations against

Patna High Court Cr.Misc. No.20015 of 2015 (2) dt.25-06-2015 2/2 the petitioners. Learned counsel for the petitioners further submits that the petitioners are willing to make a bona fide offer of depositing in the court below the rest amount due to the complainant.

Considering the fair submissions made on behalf of the petitioners, let the petitioners deposit the rest amount of Rs.11,000/-, which stand due with the complainant, in the court below i.e., in the court of learned Judicial Magistrate, Ist Class, Saharsa. In the event of such amount having been deposited, the court below should not take coercive steps against the petitioners in pursuance of Complaint Case No.99-C of 2014. Let the petitioner appear before the court below within a period of three weeks from the date of receipt/production of a copy of this order with the amount aforementioned. (Anjana Mishra, J) PNM U T
