JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-07-2019 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Ramgarhwa P.S. Case No. 317 of 2018 for the offence under Sections 147, 148, 149, 341, 323, 307, 326, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Earlier the application for grant of bail was withdrawn by the learned counsel for the petitioner on 25.04.2019 (Cr. Misc. No. 27309 of 2019).

The present bail application has been filed on 31.05.2019 and this Court has called for the case diary vide order dated 19.06.2019 to ascertain whether any injury was found on the person of the informant's side, which is attributed to this petitioner.

Patna High Court CR. MISC. No.35736 of 2019(4) dt.17-07-2019 2/2 On the basis of the case diary, learned counsel for the State submits that there is only one injury found, which is not attributed to this petitioner.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 317 of 2018.
