JUSTICE RAKESH KUMAR ORAL ORDER 04-06-2019 Heard Sri Rai Mukesh Sharma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 05.01.2019, as stated in paragraph-14 of the petition, has prayed for grant of bail in Cheriabariarpur P.S. Case No.02 of 2019 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act, 1959.

Learned counsel for the petitioner, at the very outset, has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. He further submits that the petitioner has falsely been apprehended on accusation of recovery of one countrymade loaded pistol and one live cartridge, whereas seizure

Patna High Court CR. MISC. No.35929 of 2019(2) dt.04-06-2019 2/2 witnesses are police personnel and no independent witness has been cited as seizure witness. He further submits that the case has not proceeded properly and the petitioner is languishing in jail custody since 05.01.2019.

Learned Addl. Public Prosecutor has opposed the prayer for bail.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Pramod Sahni@ Pheko Sahni @ Phucho Sahni be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
