1. Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with S. Tr. No. 729/2022 arising out of Jalalpur P.S. Case No. 12 of 2020 registered for the offence under Sections 302/201/120B of the Indian Penal Code.

3. As per the prosecution case, the dead body of the deceased who is the brother of the informant was found near Canal.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2022 and the name of the petitioner has come on the confession of co-accused Nayab Alam.

5. Learned counsel for the petitioner further

Patna High Court CR. MISC. No.39173 of 2023(2) dt.21-07-2023 2/2 submits that co-accused Nayab Alam has been granted bail by this Court on 08.02.2023 in Cr. Misc. No. 42038 of 2022.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Additional Sessions Judge, Saran at Chapra/concerned Court below in connection with S. Tr. No. 729/2022 arising out of Jalalpur P.S. Case No. 12 of 2020. (Sandeep Kumar, J) Shishir/- U T
