2. The petitioner is apprehending arrest in connection with Srinagar P.S. Case No.20 of 2023 lodged on 16-02-2023, for the offences punishable under Sections 341, 323, 342, 307, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against seven named accused persons including the present petitioner with allegation that they have caught the informant at the rifle point and snatched his mobile, make naked and assaulted as well as prepared video under a conspiracy. Thereafter, it has been threaten by the named co-accused, Uma Nand Singh that if he will adduce evidence then the entire family shall be disturbed. 4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that it is true that name of petitioner has been inserted in the FIR, but there is neither any allegation of act or overt act against the petitioner.
5. Counsel submits that the criminal antecedent of the petitioner is clean and it has been especially pleaded by the counsel for the petitioner that his name has been inserted in this case under a conspiracy. He further submits that the petitioner is a maternal nephew of the named co-accused, Puneet Singh as stated in paragraph 10 of the bail petition.
6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is allegation in the FIR that the petitioner is involved in the said event.
7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of J.M.-1st, Class, Madhepura in connection with
