The petitioners apprehend their arrest in Complaint Case No. 213 (C) of 2012, registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code and Section 138 of the N.I. Act.
A deed of agreement to sale was executed on payment of Rs. 14,51,000/-, but the same could not be executed as the property was mortgaged to UCO Bank. The complainant demanded money. The petitioners paid Rs. 10,00,000/- and thereafter also paid Rs. 4,51,000/- and got the deed of agreement to sale returned.
Patna High Court Cr.Misc. No.16800 of 2015 (2) dt.06-05-2015 2/2 It has been submitted that no money is lying due against the petitioners.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri R.R. Raman, the learned Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No. 213 (C) of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
