The matter has been taken up through video conferencing.
The petitioner apprehends his arrest in Hajipur Town PS Case No. 54/2017 registered under Section 341, 323, 307, 504, 506, 379, 436,34 of the Indian Penal Code. The informant, Jyoti Yadav, driver of the ambulance, alleged that he received information that a girl died in a road accident near Hathsarganj. The informant went to the accident spot with his ambulance but there was strong mob of 300-400 people who had blocked the road as mark of protest. The informant further alleged that the persons who were protesting damaged the ambulance of the informant and also assaulted him. Someone snatched money from the possession of informant.
The learned counsel for the petitioner submits that for the same occurrence Hajipur Town PS case No. 55/2017 was
Patna High Court CR. MISC. No.37387 of 2020(2) dt.29-06-2021 2/2 registered u/s 353 and other minor Sections of the IPC and the petitioner has also been named in that case but he has already been granted anticipatory bail vide order dated 17.07.2018 passed in Cr. Misc. No. 40843/2018 and for the same occurrence the present case has been lodged on the statement of ambulance driver.
Taking into consideration the facts that petitioner has already enlarged on anticipatory bail in one case for the same occurrence instituted on the basis of fard bayan of SI of Hajipur Town PS and for the same occurrence the informant, driver of the ambulance, lodged the present case in which petitioner has also been made accused, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order shall be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town PS case No. 54/2017, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
