JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 387 and 506 of the Indian Penal Code.

It is alleged that from mobile no. 8539974099 extortion money of Rs. 3,000,00/- was demanded. It is submitted by the learned counsel for the petitioner that on the alleged date of occurrence the mobile was registered in the name of one Santosh Kumar Singh. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for 3 months in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.14723 of 2015 (2) dt.10-04-2015 learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur, in connection with Bochaha P.S. Case No. 238 of 2012, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

In the meantime, learned court below get it verified that the alleged mobile from which extortion money was demanded is not registered in the name of the petitioner. If the mobile was not registered in the name of the petitioner then the learned court below will confirm the provisional anticipatory bail of petitioner, and if it registered in his name, then the petitioner will surrender and pray for regular bail.
