JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 454, 380, 494, 497, 34 of the Indian Penal Code.

The prosecution case is that the petitioner developed intimacy and established physical relationship with the wife of the informant and subsequently performed marriage. It is also alleged that the petitioner along with wife of the informant took away a briefcase containing cloths and ornaments worth Rs. 24,000/-.

It is submitted by learned counsel for the petitioner that in fact the informant has deserted his wife and since petitioner being neighbour was sympathetic to her, hence the accusation has been levelled. It is further submitted that petitioner has not performed marriage with the wife of the informant.

Patna High Court Cr.Misc. No.25014 of 2016 (2) dt.20-06-2016 2/2 Let learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the suspicious nature of accusation and the fact that wife of the informant never alleged anything against the petitioner, if the petitioner surrenders within a period of six weeks in connection with Manihari P.S. Case No. 46 of 2016, pending in the Court of learned Chief Judicial Magistrate, Katihar. With the observations above, the application stands disposed off.
