JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner and others are said to have fired on the deceased, but it is specific that the petitioner was armed with Katta at the time of alleged occurrence and the post-mortem report of the deceased goes to show that the deceased sustained only one injury.

Therefore, again I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with S.Tr. No. 827/2016, arising out of Budha Colony P.S. Case

Patna High Court Cr.Misc. No.5692 of 2017 (4) dt.29-03-2017 2/2 No. 245/2015, pending in the court of Additional Sessions Judge IV, Patna stands rejected.
