JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This application, for grant of anticipatory bail, arises out of Kangali P.S. Case No. 7 of 2019, disclosing offences under Sections 147, 341, 323, 354(B), 379, 448 of the Indian Penal Code.
Allegation against the petitioner and others is that they entered inside the house of the informant and abused and assaulted her and this petitioner torn the samiz of the informant. Submission of learned counsel for the petitioner is that there is delay of seven days in lodging the F.I.R. and earlier a case was lodged by one of the co-accused against the informant and others and due to which, this present false case has been lodged Learned counsel for the State and learned counsel for

Having heard both sides, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Kangali P.S. Case No. 7 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
