Mr. Mithlesh Kumar Khare, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 27-06-2019 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Bypass P.S. Case No. 377 of 2018, registered for the offence under Sections 341, 323, 325, 307, 504 and 506 of the Indian Penal Code.

As per the F.I.R., while the informant, namely, Manish Kumar, was coming along with his mother, they saw that a flex board was placed in the land of his mother and when he was reading the said flex board, a Maruti Car came there and

Basically, it is a family dispute and altercation took place on account of taking possession of the land. Specific allegation has been made against Uday Yadav and Binod Yadav to have assaulted the informant and his mother. No specific allegation has been made against these petitioners. Looking to the aforesaid facts, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.- IV, Patna City, in connection with Bypass P.S. Case no. 377 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
