The petitioner seeks bail in Parasi P.S. Case No. 62 of 2020, registered for the offence under Sections 302, 201, 120(B), 34 of the Indian Penal Code.

As per the prosecution case, son of the informant went alongwith F.I.R. named three accused persons, but he did not return and later on, his dead-body was recovered near a river with some injuries.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Jata Paswan, who has already been granted bail by a coordinate Bench of this Court, vide order dated 30.11.2021 passed in Cr.Misc. No.

Patna High Court CR. MISC. No.47982 of 2021(3) dt.07-01-2022 2/2 33009 of 2021. It is further submitted that other two F.I.R. named accused persons have also been granted bail by this Court, vide order 15.12.2021 passed in Cr.Misc. No. 38158 of 2021 (Moti Yadav) and order dated 20.12.2021 passed in Cr.Misc. No. 25110 of 2021 (Dharmendra Saw). There is no material against this petitioner to show his complicity in the aforesaid crime. Petitioner has got clean antecedent and he is in custody since 02.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge IV, Jehanabad in connection with Parasi P.S. Case No. 62 of 2020, corresponding to S.Tr.No. 105 of 2021.
