JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,325,307,380 and 354 of the Indian Penal Code.

It is alleged that on 8.1.2014 the petitioner and other accused came variously armed, assaulted the informant when the family members of the informant came to rescue, they were also assaulted by the accused persons and the box containing jewellery and cash were taken away.

It is submitted by the learned counsel for the petitioner that for the occurrence of 8.1.2014 at 7 P.M. the FIR was registered on 10.1.2014 at 10.45 AM but the victim was examined

Patna High Court Cr.Misc. No.17432 of 2015 (2) dt.14-05-2015 2/2 by the doctor prior to the time of occurrence on 8.1.2014 at 10.50 A.M. Moreover, the injury has been found to be simple and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the medical examination of the injured prior to the time of occurrence mentioned in the FIR, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Kishanpur P.S. Case No. 15 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
