JUSTICE BIRENDRA KUMAR ORAL ORDER 07-03-2017 Petitioner is directed to make necessary correction of the bail petition in respect of the name of district. Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation is that the petitioners and others, allegedly, assaulted to Sanjeev Kumar as he had love-affairs with the daughter of the informant. On the very next day, dead body of Sanjeev Kumar was found hanging with a tree.

The Doctor has found a case of suicide and, accordingly, charge-sheet has been submitted by the police under Section 306/34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.2634 of 2017 (3) dt.07-03-2017 2/2 Submission of the petitioner is that this is not a case of abetment at the hands of the petitioners to commit suicide by the deceased. There is no eye-witness of the occurrence. Petitioners are in custody since 18.10.2016.

Considering the entire facts, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/successor Court in connection with Korha Police Station Case No. 200 of 2016.
