The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the accused persons including the petitioner herein surrounded the husband of the informant and started to assault him. On the orders of Nirmal Singh it is stated that Bipin Kumar fired on the informant's husband. The other accused persons including the petitioner also assaulted him.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case.

Patna High Court CR. MISC. No.48054 of 2021(2) dt.14-02-2022 2/2 Charge sheet has been submitted in the case under sections 147, 341, 323, 325 504 and 506 of the Indian Penal code which are all bailable. Petitioner is in custody since 21.6.2021 and investigation in the case has concluded.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the submissions made on behalf of the petitioner and the petitioner having remained in custody for more than 7 months, the Court directs the petitioner to be enlarged on bail in connection with Itarhi P.S. Case no. 148 of 2021/G.R. no. 1063 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
