1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Harnaut P.S. Case No. 673 of 2023 dated 03.12.2023 registered for the offence(s) punishable under Section(s) 341, 448, 307, 504, 506, 379/34 of the Indian Penal Code and under Section 27 of Arms Act.

3. Mr. Sunil Kumar, learned counsel for the petitioner submits that the FIR has been registered against this petitioner and his son Gaurav Kumar, in fact on the alleged day of occurrence between the petitioner's son Gaurav Kumar and son of the informant an alteration took place while playing football game which resulted in free-fight between them and in that occurrence the informant's son Mayank Kumar received

Patna High Court CR. MISC. No.41577 of 2024(2) dt.09-07-2024 2/2 abrasion near his ear and thereafter the informant concocted a false story and lodged the FIR. It is further submitted that in the FIR the main allegation of causing fire-arm injury to the informant's son is against the petitioner's son and the petitioner has fair and clean antecedent.

4. Mr. Ajit Kumar, learned APP appearing for the State has opposed the bail prayer of the petitoner.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent, this court is inclined to accept his prayer for anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Harnaut P.S. Case 673 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
