JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Heard learned counsels for the petitioner, complainant and the State.

The petitioner is apprehending arrest in a complaint case filed with accusation under Sections 323,379 and 406 of the Indian Penal Code.

It is alleged that rupees two lacs was paid to the petitioner for execution of sale deed with regard to 7.5 dhurs of land. Subsequently, the complainant came to know that the land in question was disputed when the money was demanded back but the same was not returned and the complainant was forced to sign on blank papers.

It is submitted by learned counsel for the petitioner that

No.14731 of 2015 (2) dt.10-04-2015 2/2 there is no proof with regard to payment nor there is anything on record to suggest that the blank papers on which signatures of the complainant were obtained, were misused in any manner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Gopalganj in connection with Complaint Case No. 1675 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
