JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489-B, 489-C/34 of the Indian Penal Code and Sections 15(i)(a) (iii-a) read with Sections 16/17 of Unlawful Activities (Prevention) Act, 1967. Again, I am not inclined to release the petitioner on bail on the grounds mentioned by me in my previous order dated 20.06.2016 passed in Cr. Misc. No. 24873 of 2016. Hence, the prayer for bail of the petitioner in connection with Sessions Trial No. 791 of 2016 arising out of A.T.S (Bihar) P.S. Case No. 01 of 2016 pending in the court of Additional Sessions Judge-IX, Patna stands rejected.
Patna High Court Cr.Misc. No.1940 of 2017 (3) dt.15-03-2017 2/2 However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order.
The report of trial court goes to show that one coaccused has filed petition under Section 227 of the Cr.P.C. which is still pending and, therefore, the trial court must dispose of the aforesaid petition on the next date fixed for hearing on the aforesaid petition.
Let a copy of this order be sent to Senior Superintendent of Police, Patna with direction to him to ensure the presence of prosecution witnesses of aforesaid case before the trial court without any delay.
