19-07-2017 Heard Sri Rewti Kant Raman, learned counsel for the petitioner, learned A.C. to Addl. Advocate General-12 as well as Sri Surya Narayan Sah, learned counsel for private opposite parties.
The present petition has been filed with a prayer to restore C.W.J.C. No. 4057 of 1999, which stood dismissed due to non-compliance of peremptory order dated 03-07-2015. By the said order, the petitioner was granted peremptory time for filing requisites for service of notice on substituted legal heirs of respondent no. 9.
In paragraph - 3 of the present petition, it has been indicated that due to inadvertence and mistake on the part of the clerk, the order was earlier not complied with. However, subsequently the order has already been complied with on
Patna High Court MJC No.4234 of 2016 (4) dt.19-07-2017 2/2 04-09-2015 and restoration petition was filed for restoring the writ petition.
Considering the fact disclosed in the petition, same is allowed.
Let C.W.J.C. No. 4057 of 1999 be restored to its original file.
