JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioners and the State.
The petitioners seek bail in a case instituted for the offence under Sections 272 and 273 of Indian Penal Code and Sections 30(a) and 38(i) of Bihar Madh Nishedh and Excise Act, 2016.
It is alleged that total 94 bottles of 375 ml. of Imperial Blue Whisky was recovered from a tempo on which both the petitioners were sitting. They started running away but chased and apprehended by the police. Both the petitioners have been in custody since 20.10.2016. It has been mentioned in para-3 of bail petition that they have clean antecedent.
Patna High Court Cr.Misc. No.5676 of 2017 (2) dt.23-02-2017 2/2 Keeping in view the period spent by the petitioners in custody and also they have clean antecedent, let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Banka, in connection with Shambhuganj P.S. Case No. 151 of 2016, subject to the condition that both the bailors will be the close relative of the petitioners.
