The petitioner seeks bail in connection with Special N.D.P.S. Case No.02 of 2017 arising out of Praharbal Nawada P.S. Case No.01/2017 for the offence punishable under Sections 20(b) of the N.D.P.S. Act, which is pending in the court of learned Additional Sessions Judge-I-cum-Special Judge (NDPS Act), Nawada.

70 Kgs. Ganja has been recovered from a vehicle. Petitioner was at the spot. Thrice petitioner's prayer for bail has been rejected in Cr.Misc. No.52891 of 2017 on 21.11.2017, Cr.Misc. No.62587 of 2018 on 10.10.2018 and Cr.Misc. No.38970 of 2019 on 14.08.2019.

Patna High Court CR. MISC. No.36594 of 2020(6) dt.08-03-2021 2/2 A report has been received from the court, wherein it has been stated that one witness-A.S.I. of Excise is yet to be examined and for appearance of the said witness, next date has been fixed on 17.02.2021.

In view of the such report, this Court, for the present, does not consider it appropriate to enlarge the petitioner on bail. The same is rejected.

This Court would only express that without granting any unnecessary adjournments; and expeditiously the matter may be brought to its logical conclusion.

The order, however, may be communicated to the court concerned, i.e., the court of learned Additional Sessions Judge-I-cum-Special Judge (NDPS Act), Nawada. This Court would expect that the petitioner's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office.
