JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-04-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case for the offence under Sections 366(A), 341 and 323 of the Indian Penal Code.

It appears from the F.I.R. that the allegation of abducting of victim is against Raj Kumar, son of Ajay Kumar Yadav.

Learned counsel for the petitioners submits that no credence can be given to the statement of the victim girl made before the police after two months of the occurrence. In the circumstances, in the event of arrest or surrender before the court below within four weeks from today the

Case no. 194 of 2014 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the condition that petitioner no.1, namely, Ajay Kumar Yadav, would not physically absent for two consecutive dates at stretch till two witnesses are examined.
