====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-02-2021 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bachhwara Rail P.S. Case No. 1 of 2020 for the offence registered under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding unknown miscreants having snatched purse from the hand of the informant who was travelling in the train and when the Railway Porter standing there tried to apprehend the said miscreants, they had fired in the air and had managed to flee away. It is alleged that during the course of investigation, the name of the petitioner has transpired in the present case and one looted mobile has been recovered from the petitioner.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.37983 of 2020(2) dt.05-02-2021 2/2 that the petitioner is innocent, has been falsely implicated in the present case and he is languishing in custody since 14.06.2020. It is further submitted that though the petitioner is accused in one other case but he is on bail in the said case. Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the material on record as also considering the period of incarceration of the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Rail Judicial Magistrate, Barauni, District-Begusarai in connection with Bachhwara Rail P.S. Case No. 1 of 2020.
