The petitioner seeks bail in connection with Chakai P.S. Case No.81 of 2016 registered under Sections 47(a) (F) of the Bihar Excise Act, Sections 53 and 57 of the Bihar Excise Amendment Act, 2016 and 273 of the Indian Penal Code. The accusation is that on receiving secret information about carrying of Indian Made Foreign Liquor in Scorpio vehicle, the police started to search the vehicles and, in that course, one Scorpio vehicle was searched from which the petitioner and four others were apprehended and 160 liters Indian Made Foreign Liquor, kept in different bottles in five bags, was recovered from the Scorpio vehicle.

No.1456 of 2017 (2) dt.17-01-2017 2/3 Learned counsel appearing on behalf of the petitioner submits that the similarly situated co-accused, Dilip Kumar alias Dilip Kumar Singh alias Dilip Singh vide order dated 06.12.2016 passed in Criminal Misc. No.51446 of 2016, Rahul Kumar vide order dated 22.12.2016 passed in Criminal Misc. No.52582 of 2016, Amit Kumar vide order dated 21.12.2016 passed in Criminal Misc. No.54100 of 2016 and Ranjan Kumar vide order dated 19.12.2016 passed in Criminal Misc. No.49023 of 2016 have already been granted privilege of bail by different Benches of this Court. Petitioner is in custody since 25.07.2016. Further submission is that while the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, but in both the cases, the petitioner is on bail.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Jamui, in connection with Chakai P.S. Case No.81 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
