The petitioner seeks pre-arrest bail in connection with Bhagwanganj P.S. Case No.165 of 2018 for the offences punishable under Sections 341, 323, 504, 307, 448 and 506 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that there is a case and counter case. There was minor scuffle in which both parties sustained simple injuries. However, an exaggerated version has been given in the FIR and the case has been registered under Section 307 of the Indian Penal Code On going through the case diary, learned counsel for the State submitted that the injury report suggests that the informant had sustained simple injury over his forehead. Patna High Court CR. MISC. No.36625 of 2019(5) dt.16-11-2019 2/2 State has also admitted that there is a counter case. Regard being had to the nature of allegation as also the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of six weeks, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Bhagwanganj P.S. Case No.165 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
