JUSTICE RAKESH KUMAR ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and Sri Pradeep Narayan Kunwar, learned A.P.P.

The petitioner, apprehending his arrest in connection with Complaint Case No. 535 of 2011 corresponding to Tr. No. 2218 of 2012 in which cognizance order was passed for the offence under Section 498A of the Indian Penal Code, has prayed for grant of bail.

It was accepted by learned counsel for the petitioner that in this case cognizance order was passed in the year 2011. Keeping in view the fact that cognizance order was passed long back in the year 2011, it would not be advisable to extend the privilege of anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.37208 of 2014 (2) dt.20-02-2015 2/2 Petitioner may surrender before the court below and make a prayer for grant of regular bail. If such petition is filed within a period of six weeks from today, the learned court below without being prejudiced with this order may examine the same on its own merit and pass appropriate order in accordance with law preferably on the same date.
