JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 04-09-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Katoriya (Suiya) P.S. Case No. 20 of 2015 registered under Sections 364, 302, 201 and 120-B read with 34 of the Indian Penal Code.
According to the FIR, the petitioners and two others are alleged to have conspired together and committed murder of the father of the informant. In course of investigation, mutilated body of the deceased was recovered. In paragraph no. 103 of the case diary, statement of one Adalat Ansari has been recorded in
Patna High Court Cr.Misc. No.17473 of 2015 (3) dt.04-09-2015 2 / 2 which vivid description of the commission of the crime has been narrated which clearly shows the active complicity of the petitioner in the alleged offence.
Regard being had to the gravity of the offence and the role played by the petitioners, I am not inclined to grant him anticipatory bail. Accordingly, the application for anticipatory bail is rejected.
