The petitioner apprehends his arrest in Kargahar P.S. Case No.202 of 2020 registered under Section 366A of the Indian Penal Code.
The informant (mother of the victim) disclosed that when the informant woke up in the morning, she did not find her daughter inside the room. Anup Kumar was having talked with her daughter on mobile. When the informant went to the house of Anup Kumar, his father (petitioner) misbehaved with the informant.
Learned counsel for the petitioner submits that there is specific allegation against Anup Kumar that he kidnapped the daughter of the informant. The petitioner is the father of Anup Kumar. The victim was recovered and she made her statement
Patna High Court CR. MISC. No.35939 of 2020(2) dt.07-04-2021 2/2 under Section 164 of the Cr.P.C. The victim herself disclosed that nobody kidnapped her.
Having considered the facts aforesaid and the fact that the petitioner is the father of Anup Kumar, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sasaram, Rohtas in connection with Kargahar P.S. Case No.202 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
